These terms govern your use of the Gone Whale Watching website and the booking of our tours and charters. By using this site or booking a trip, you agree to these terms.
Tours & sightings
Our tours operate on the open ocean and depend on weather, sea conditions, and wildlife. While we have an exceptional sighting record and quote real, honest odds, wildlife is wild — sightings are described as probabilities and cannot be absolutely guaranteed except where a specific written guarantee is stated for a particular tour (for example, the Premium 5-Hour Extended Whale Watch's "guaranteed sightings or book again free"). Quoted success rates and seasonal odds reflect past results and are not promises of any individual trip's outcome.
Booking & payment
Calendar tours are booked and paid through FareHarbor, our third-party reservation provider, subject to its terms. Private charters, the 5-Day Maui Experience, and group or mission trips are arranged directly with us by phone or email. Some tours have published prices; others are quoted at the time of booking. Extended trips that travel into outer Mexican waters require valid passports for all guests.
Cancellations & weather
Because we operate small, high-speed vessels open to the elements, trips may be rescheduled or canceled for unsafe conditions at our discretion. Cancellation, rescheduling, and refund terms are provided at the time of booking through FareHarbor or in your direct booking confirmation.
Safety & conduct
All vessels are U.S. Coast Guard inspected. Guests must follow crew instructions at all times for their safety and the welfare of the wildlife. We observe marine mammals responsibly and in accordance with applicable wildlife-viewing guidelines. The captain may decline boarding or end a trip for behavior that endangers guests, crew, the vessel, or wildlife.
Assumption of risk
Ocean activities involve inherent risks. By booking, you acknowledge these risks and agree to any waiver or liability terms presented at the time of booking or boarding.
